Notes for RICHARD HORNE, SR.:
This person's relationship as a brother to William Horn of Nansemond is speculative, but the relationship seems to be likely and reasonable. (As is discussed elsewhere at this web site, early results of yDNA data have, at least as yet, not provided indication that these two men were kin).
This person's identity is defined by his ownership of property in Chowan precinct in the early 1700's and the likelihood that he and his family was located in Edgecomb and Northampton Counties in the mid 1700's.
Margaret Hoffman's abstracts of deeds from Chowan Precinct, NC, 1696 to 1723 contains several relevant entries. The following three related deeds from 13 and 14 July 1716 were abstracted as follows:
1) #895-DB#B1: Thomas Kirby Sr of Albemarle County, planter, and Ester Kirby to Henry Wheeler of same. 13 July 1716. for __ pounds. 120 acres more or less at the mouth of Poplar Neck branch on Turkey Creek, joining Mill Path, ye mouth of Mill Swamp and the creek and is part of 1200 acres on the south side of Meherring river granted to the sd Kirby 9 Jan 1712/13. Wit: Richard Washington, Richard Horn (his mark]. Reg 6 Aug 1716.
2) #897-DB#B1: Thomas Kirby Sr of Chowan Prect. with the consent of Ester my wife to Richard Horn (residence not given). 14 July 1716. Consideration (not given) 120 acres at the mouth of Poplar Neck Branch at ye upper bounds of Henry Wheeler's Land, joining the old Mill Path, the head of a branch and Turkey Creek. [See Map: C:/FTW/Deeds/kirbycrk.sa5, showing area NW of Murfreesboro, NC in Hertford and Northampton counties where Kirbys creek enters Turkey Creek and then from the west into Meherrin River]
3) #896-DB#B1: Thomas Kirby with Ester my wife to Thomas Kirby our son. 14 July 1716. Letter of Attorney to acknowledge our Right to what Lands we have sold to Henry Wheeler and Richard Horn. Wit: Laurence Hoby [his mark], John Proctor [his mark]. Reg 6 Aug 1716
From the Hoffman resource, the following deed defines properties located near that of Richard Horn.
4) #1210-DB#B1: Thomas Kirby of Chowan Prect. and Esther Kirby to Richard Washington of ye Province of N. C. 1 May 1718 for __ pounds. 300 acres more or less at the mouth of Richard Horn's branch at Turkey Swamp, Joining Horn, the Mill Path, the Mill swamp, the Indian Path that goes by ye Woolf Pitt, Proctor's Tarr Kill and the swamp. Wit: Thomas Kirby, John Charleton. Reg 23 Apr 1719
The following abstracts are from either Margaret Bell, Colonial Bertie Records, 1720-1757 or from the series by Stephen Bradley on the The Deeds of Bertie Co NC, 1757-1794.
In 1724 Richard Horn and his wife sold the 120 acres he had obtained from Kirby in 1716. (Bertie Deed Book A352(20): " Richard Horn & wife Sarah to Arthur Williams. Nov 9 1724. 10 pounds for 120 acres. Same purchased of Thomas Kirby May 14 1716. Part of tract granted said Kirby of 1200 acres dated January 9 1712 on SS Meherrin River and Turkey Creek. Adj Henry Wheeler and Mill Path. Wit: Francis Morecock, William Aring. Nov Ct 1724. John Sutton."
1n 1734 Richard Horn sold land adjacent to Thomas Horn, probably his son, in Pottycasey Woods.
"D51(139) Richard Horn of Edgecombe Precinct to John Taylor. March 4, 1734. 40 pounds for 300 acres. In Pottycasey Woods adj Thomas Horn, "part of Patent of land dated 1668. Wit: Robert Lassiter, John Bohoon, Charles Cavenah. May 6 1734. John Wynns." I do not have a contemporaneous record of how Richard Horn obtained this property, nor a record of how Thomas Horn obtained the adjoining property. However, the following entry indicates that the 640 acres was patented to Richard Horn in 1723.
In 1746/47 Thomas Horn is recorded as selling 640 acres "in Potacasy Woods". "DB1-285-45 Thomas Horne of Northampton County to William Eldridge of Northampton Co. 24 Feb 1746/47. 60 pounds current money of VA. 640 acres in Potacasy woods and on the west side of Patti's Delight, joining a posocin, as by patent to Richard Horne 4 Aug 1723. Wit: John Dew, John Hooker. Reg Northampton Co Feb Ct 1748. John Hooker DCC." [This 640 acres is just southwest of Milwaukee, NC, in Northampton County, N 36d, 23.33m/W77d,15.66m]
It appears that this 640 acres had been given to Thomas by his father, Richard, some months earlier, as the following entry suggests:
"DB1-280-44 Richard Horne, Sr of Edgecombe Co to Thomas Horne of Nort Co. 3 May 1746. for the love, good will and affection which I have and do bear unto my will beloved son Thomas. 640 acres all my plantation on the north side of Potacasie Creek and the west side of Patty's Delight, joining a posocin. Wit: Richard Horne, John Taylor T his mark, Thomas Horne. Reg Nort Co Nov Ct 1746. John Hooker DCC."
Only shortly earlier, 1n 1745, Richard Horn had sold two adjacent parcels of Edgecomb County property and purchased a third:
1) "467(210) RICHARD HORN of Edge Co to EDWARD FLOWERS of Edge Co 12 Feb 1745 10 pounds sterling money of England 200 acres on the south side of Tarr River, joining the river and the sd Richard. Wit: ISAAC RICKS, HENRY FLOWERS REG. Edge Co Feb Ct 1745 Robert Forster CC."
2] "469(210) RICHARD HORN, JR of Edge Co to THOMAS BARNS of Edge Co 20 May 1745 30 pounds current money 200 acres, joining the river and EDWARD FLOWERS."
3) "184(135) JOHN TAYLOR of Edge Co to RICHARD HORN of Edge Co date not given 20 pounds of current money of Va 100 acres on the north side of Tosniot swamp, part of a patent to the sd TAYLOR 11 apr 1745. Wit: THOMAS HORN, WILLIAM HORN Reg Edge Co Feb Ct 1752 B Wynns CC."
At the same time, a Thomas Horn, presumably Richard Horn's son, purchased nearby Tosniot Swamp property from John Taylor.
"452(208) JOHN TAYLOR of Edge Co to THOMAS HORN of Edge Co 14 Feb 1745 15 pounds of current Va money 150 acres on the south side of Tosneott swamp. Wit: JOHN LAWHON, NEHEMIAH JOYNER, JR Reg Edge Co Feb Ct 1745 R. Forster CC."
In 1750 Richard Horn sold 250 acres of land in Edgecombe County "south of the Tarr river" and repurchased the same land in 1754:
1) "Edgecombe 75(126) RICHARD HORN of Edge Co to WILLIAM SKINNER of Chowan Co 5 Nov 1750 70 pounds of current money of Va 250 acres on the south side of Tarr river, joining the river part of 640 acres granted to the sd RICHARD 5 Mar 1753 (sic) Wit: E. RICHARD, KALLUM ROSS, WILLIAM TAYLOR Reg Edge Co May Ct 1751 B. Wynns CC."
2)"Edgecombe 210(58) WILLIAM SKINNER of Edge Co to RICHARD HORNE of Edge Co, 27 Oct 1754 70 pounds current money of Va. 250 acres more or less on Tar River where the sd HORNE formerly lived, the sd tract joining the river being the land the sd SKINNER bought of the sd HORNE 5 Nov 1750. A Richard Horne witnesses a deed in 1746 in Northampton County, I speculate it is a transfer of Property from his father to his brother. On the other hand, it may be that there was a shortage of witnesses that day and that both the Buyer and Seller are also recorded as witnesses. Vide Infra.

Gwen Horn mentions a 1783 Halifax County will of a Richard Horn with wife Sarah, sons Howell, James, Henry and dtrs Rhoda, Patience, and Hannah Wright. A copy of this will is present on p 127 of the Ray L Horn Book. Since this Richard Horne died between 1779 and 1783, he is probably not Richard, Sr., the presumed brother of William of Nansemond. Possibly the Richard Horn with the 1783 Halifax county will is this Richard Horne, ie, Richard Horne, Jr). I am making that presumption in constructing this list of descendants of this Richard Horne, Jr.
Ruth Hinkle Kicklighter (rkickli@phoenix.net) descends from the Richard Horn with wife Sarah and the 1783 Halifax will. See information from her correspondence regarding these issues.
Ruth and I both acknowledge that it is possible that the Richard Horne with the 1783 will is actually the Richard Horne Sr., also with wife Sarah, but if so he lived to be a very old man, and many difficult and unlikely presumptions about his children are required.

I am assuming that the Thomas Horne of Northampton with the following will is the son of the Richard Horne discussed herein.
From Hoffman, Northampton Co NC Will Abstracts, 1759-1808: "Will 195 pg. 288 Thomas Horne 9 September 1775. Sept Court 1777. Sons James Horne and William Horne and Joseph Horne 10 sh each. Dtr Tabitha Lancaster 3 pounds. To my dearly beloved wife Mary Horne the land whereon I now live and part of a tract James Horne lives on for her natural life and then sd. land to be equally divided between my sons Moses Horne and Thomas Horne. To my wife also my house hold goods and moveable estate for her natural life and then to be divided between my 2 sons and other daughters, namely Moses, Thomas, Sarah, Elizabeth and Mary Horne.
Extrs, my sons Joseph and William. Wit: Joseph Horne, Moses Horne."

It seems likely that the following deed describes the gift of property from this Thomas Horne to his son James. "DB5- 1181-245 Thomas Horne of Nort Co to his son James Horne of same. 20 Feb 1773. Deed of gift. 220 acres, joining Milgum Run Branch, John Norsworthy, James Moore, John Lawrence, Wm Granberry. Wit: Joseph Horne. Mar Ct 1773."
There are many deeds in Northampton as well as in Bertie and Edgecomb counties naming "Thomas Horne of Northampton". It will be important to try to separate and clarify the identities of this Thomas, son of Richard, from the other Thomases, particularly the son of William of Nansemond and Thomas, the son of Henry the Quaker, and his son, Thomas, Jr.

From this will it appears likely that William Horne was either Childless or had outlived his children and any of their offspring.
The numerous separate William Horn(e)s listed in the will is of interest.
The term "cousin" may be used non-specifically. Eg, the first cousin William is "the son of my Brother".
It is tempting to consider that the last named Cousin in the will is "Colonel William", son of Henry the Quaker, since he was often referred to as "William Horn of Bertie Co". However, by 1808 Colonel William had seemingly been out of sight for quite a while. What about it, Gwen?

"Will 163, p 242. Moses Horn. 26 April 1781. September Court 1781. To my wife Milly Horn all my hogs and salted provisions, etc. To my brother-in-law Sion Rutland my wearing clothes, new Rackoon Hat, etc. 1 barrel of Brandy to be sold to pay my Debts. All the rest of my estate to go to my beloved wife and Child she is now big with.

It appears that at his death Moses was young and still childless. Perhaps his wife's maiden name was Rutland.
[June 24, 1998: Gwen Battle Horn tells me she believes that this Moses Horn was childless, and that he is the Moses who executed the following sale of property.
"Northampton County DB1-219-35 Moses Horn of Edge Co to William Roberson of Nansemond Co Va. 13 May 1745. 20 pounds current money of VA. 130 acres in Northampton and Bertie Counties, joining a meadow, part of a patent formerly granted to Henry Baker for 260 acres, 2 Apr 1722. Wit: Charles Horne, William Horn X his mark. Reg Nort Co. Nov Ct 1745. R. Forster."
Only a very short time earlier a Moses Horn had purchased this property from Charles Horne. I have regarded elsewhere that the above 'Moses Horn of Edge. Co." was the son of William of Nansemond (not the grandson of Richard Horne, and I am inclined to believe that interpretation is more likely to be correct.]

Sons Thomas, William, and Michael are named in the Will, to which compare the bequests in the Will of William Horn, the childless, died in 1808 in Northampton County.
